Terms of Service

These Terms of Service ("Terms") govern your use of the LEX Word Practice mobile application ("the App"), provided by Josiah Lybbert ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, in accordance with the Apple Media Services Terms and Conditions and these Terms. This license is for personal, non-commercial use only.
2. Subscriptions and In-App Purchases
The App may offer optional in-app subscriptions and purchases ("PRO features") through Apple's App Store.
- Billing. All purchases are processed by Apple and billed to your Apple ID.
- Auto-Renewal. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your device's App Store account settings.
- Refunds. Refund requests are handled by Apple under their refund policy. We cannot issue refunds directly.
- Price Changes. We may change subscription prices in accordance with App Store rules. You will be notified before any price change takes effect.
3. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law.
- Use the App for any unlawful purpose.
- Interfere with or disrupt the App or attempt to gain unauthorized access to any part of it.
- Redistribute, sublicense, or resell the App or its content.
4. Intellectual Property
The App, including its design, code, graphics, and content (excluding any third-party lexicon data used under license or in the public domain), is owned by Josiah Lybbert and is protected by copyright and other intellectual property laws. Word lists and lexicons included in the App remain the property of their respective owners and are used solely for educational purposes.
5. User Data
LEX Word Practice does not collect or store personal data on our servers. Your study progress is stored locally on your device and, if enabled, in your own private iCloud account.
You are responsible for maintaining backups of your iCloud data through your Apple ID.
6. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT STUDY CONTENT WILL BE ACCURATE OR COMPLETE.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JOSIAH LYBBERT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Apple-Specific Terms
You acknowledge that these Terms are between you and Josiah Lybbert, not with Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, who may refund the purchase price; Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.
9. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms. You may stop using the App at any time by deleting it from your device.
10. Changes to These Terms
We may modify these Terms from time to time. Updated Terms will be posted here with a new "Last Updated" date. Continued use of the App after changes take effect constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the App shall be resolved in the state or federal courts located in Utah.
